1Acceptance of Terms
Welcome to AI Virtual Staging ("we," "us," or "the Service"). This agreement constitutes a legally binding contract governing your access to our B2B/B2C virtual staging platform, API services, and related applications. By accessing our platform, authenticating via Google OAuth, or procuring credits through our payment processor (Creem), you unequivocally agree to be bound by these Terms of Service ("Terms") alongside our Privacy Policy.
If you are acting on behalf of a real estate brokerage, agency, or corporate entity, you represent and warrant that you possess the requisite legal authority to bind said entity to these Terms. If you do not agree to these Terms, you must immediately cease all use of the Service.
2Accounts and Eligibility
- 2.1 Age Requirement: You must be at least 18 years old to use this Service. If you are under 18, you may only use the Service with the permission and supervision of a parent or legal guardian.
- 2.2 Account Security: We use Google OAuth for authentication. You are responsible for maintaining the security of your Google account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
- 2.3 Termination: We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
3Payment and Refund Policy
- 3.1 Payment Processor: All financial transactions are processed by our third-party partner, Creem. We do not store or process your credit card details on our servers. By making a purchase, you agree to comply with Creem’s terms and conditions.
- 3.2 Virtual Goods & Commercial Licenses: Purchases of "Credits" or "Subscriptions" grant you a revocable, non-exclusive license to utilize our cloud-based AI generation pipeline. Credits possess zero fiat monetary value and cannot be exchanged for cash outside the Service ecosystem.
- 3.3 Strict No-Refund Policy:
- Immediate Digital Fulfillment. Due to the instantaneous commercial nature of AI inference and the immediate allocation of GPU compute resources upon clicking "Generate," all sales are strictly final. We do not provision refunds for consumed credits under any circumstances.
- Service Degradation Exceptions: In the event of documented, provable, and persistent programmatic failures (e.g., complete API outage >24 hours resulting in non-delivery of expected rendering jobs), we may, at our sole and absolute discretion, issue compensatory account credits. Fiat refunds remain strictly exempt.
- Arbitration & Disputes: You agree to contact our support desk ([email protected]) to attempt good-faith resolution of any billing discrepancies prior to initiating a chargeback dispute with your financial institution or Creem. Fraudulent chargebacks will result in immediate API key revocation and permanent account termination.
4Intellectual Property and Content
You retain full legal ownership, copyright, and distribution rights to the original unstaged property photos you upload to the platform. You explicitly represent and warrant that you hold the lawful rights, licenses, or explicit consent from the property owner/brokerage to process these images through our systems without infringing upon third-party copyrights or privacy rights.
- Subject to your complete adherence to these Terms, you are granted full commercial rights and ownership over the virtually staged images you generate using our Service. You are authorized to utilize these assets for MLS listings, print marketing, social media syndication, and client presentations.
- Algorithmic Non-Exclusivity: As inference relies on generative AI models, we cannot medically or legally guarantee cryptographic uniqueness. Distinct users providing identical empty rooms and identical stylistic parameters may inevitably generate heavily similar compositional outputs.
- Algorithmic Hallucinations: The Service provides AI-driven virtual staging which operates as an algorithmic proxy. We explicitly disclaim any guarantee that the generated images will physically represent a physically viable or legally compliant structural reality (e.g., load-bearing walls, electrical socket placement, exact dimensional scaling).
- MLS & Truth-in-Housing Mandates: You, the user/agent, bear the ultimate fiduciary responsibility for how these images are marketed. Generated materials must be clearly, overtly, and legally watermarked or explicitly captioned as "Virtually Staged" in MLS (Multiple Listing Service) databases and consumer-facing portals, strictly adhering to your local real estate commission's truth-in-advertising jurisdiction laws.
5Prohibited Conduct
You agree not to use the Service to generate, upload, or share content that:
- Is illegal, harmful, threatening, abusive, harassment, defamatory, vulgar, obscene, or invasive of another's privacy.
- Depicts sexual violence or non-consensual sexual content.
- Contains Child Sexual Abuse Material (CSAM). We report all CSAM to relevant authorities immediately.
- Infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
- Creates "Deepfakes" intended to deceive, defraud, or defame real persons.
6Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
- AI Unpredictability: Artificial Intelligence may produce artifacts, structural anomalies, or unexpected results. We do not guarantee that the virtually staged images will be completely accurate, structurally sound, or perfectly suitable for all professional real estate listings without user review.
- Service Availability: We do not guarantee that the Service will be uninterrupted, secure, or error-free. The Service relies on third-party APIs and cloud hosting (e.g., Railway) which may experience downtime.
7Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
8Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the date at the top of these Terms. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
